Terms of Service
Last updated: [effective date]
Please read these carefully. Section 3 (what Archivow is and is not) and Sections 9–11 (disclaimers, liability, and dispute resolution) limit the nature of our service and your legal rights. By using Archivow, you agree to these Terms.
1. Acceptance
These Terms are a binding agreement between you and [Archivow Operating Entity] (“Archivow,” “we,” “us”), operator of archivow.com and related services (the “Service”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Refund Policy, each incorporated by reference. If you invite another person to a shared case, you are responsible for ensuring they have agreed to these Terms before they access it.
2. Eligibility
You must be at least 18 years old, have the legal capacity to enter a contract, and not be barred from using the Service under applicable law. The Service is intended for use within the United States by people organizing their own immigration-related evidence. If you organize evidence concerning another person, you represent you have their permission as required by law.
3. What Archivow is — and is not
Archivow is a self-help software tool. It lets you store evidence you provide, organize and label it, answer questions and generate a draft first-person relationship statement in your own words that you review and edit, and compile your materials into a single downloadable PDF “evidence packet” to accompany a filing you prepare and submit yourself. Where helpful, it points you to official USCIS instructions.
ARCHIVOW IS NOT A LAW FIRM, IS NOT YOUR ATTORNEY, AND DOES NOT PROVIDE LEGAL ADVICE. You expressly acknowledge and agree that:
- No attorney-client relationship is created by your use of the Service, and no attorney-client privilege attaches to what you submit.
- We do not, and cannot, review your materials for legal sufficiency, draw legal conclusions, or apply the law to your situation.
- We do not give legal advice or recommendations about your rights, options, eligibility, strategy, or which form to use.
- We do not select forms for you, complete government forms for you, or file anything with USCIS or any agency on your behalf — you choose, complete, and file your own forms.
- We do not guarantee any outcome. We do not represent that your packet will be accepted, that your filing will be approved, or that you will avoid a Request for Evidence or denial. Immigration decisions are made solely by the government.
You are solely responsible for the accuracy, legality, completeness, and truthfulness of everything you submit and everything you file — including which forms apply, completing and filing them, whether your evidence is sufficient, meeting all deadlines, and reviewing any AI-drafted text before relying on it. The AI feature produces a draft from your input for you to review and edit; it is your statement, in your words, and may be incomplete or inaccurate. We strongly recommend consulting a licensed immigration attorney about your specific situation; only a licensed attorney can give you legal advice. If you cannot afford one, nonprofit legal-services organizations may be able to help.
4. Accounts and the shared vault
You must provide accurate information, keep one account per person, keep your credentials confidential, and notify us at hello@archivow.com of any unauthorized access. You are responsible for activity under your account. A case vault may be shared by two users — typically a petitioner and a beneficiary. Each authorized user can view, upload, edit, organize, download, and delete content and generate the packet; actions by one may affect the other. Only share access with the person whose case it is, and don’t upload anything you aren’t willing to share with the other person on the case. We are not responsible for disputes between co-users of a shared vault.
5. Acceptable use
You agree not to, and not to permit anyone to:
- use the Service for any unlawful, fraudulent, or deceptive purpose;
- create, upload, or submit fraudulent, falsified, or misleading evidence, or misrepresent any fact to any government agency;
- upload the personal data, documents, images, or communications of another person without their permission or other lawful authority;
- impersonate anyone or misrepresent your identity or relationship to the case;
- introduce malware, interfere with the Service, or attempt unauthorized access;
- reverse engineer, copy, or create derivative works of the Service except as permitted by law; or
- abuse our refund, payment, or membership terms, including by filing fraudulent chargebacks.
6. Your content and our license
You own your content. You grant Archivow a limited, non-exclusive, royalty-free license to host, store, process, render, and format your content solely to operate and provide the Service to you (including via our hosting and infrastructure providers acting on our behalf). This license exists only to run the Service and ends when your content is deleted, except for routine backups retained briefly and content we must keep by law. You represent that you have all rights necessary to submit your content.
7. Intellectual property
The Service — its software, design, templates, the “Archivow” name and brand, and related intellectual property — belongs to [Archivow Operating Entity] or its licensors. Except for your limited right to use the Service under these Terms, we grant you no rights in it, and you may not use our name or branding without our written permission.
8. Payments and subscriptions
Creating an account and using your vault is free. Generating and downloading your final PDF packet is a one-time purchase of $79 ($59 for active Plus members). “Plus” is an optional subscription at $5.99/month that automatically renews until you cancel; you may cancel anytime from your billing portal, effective at the end of the current period. All payments are processed online via Stripe (no app-store billing). You are responsible for any applicable taxes. Refunds are governed solely by our Refund Policy.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, that any packet will be accepted or sufficient, that your filing will be approved, or that any AI-generated draft or reference to government materials will be accurate or suitable for your situation. You use the Service at your own risk and subject to your own review and judgment.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Archivow and its owner, operators, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data; and will not be liable for any immigration or legal outcome — including any denial, rejection, Request for Evidence, delay, missed deadline, or other adverse action — or for information you provided. Our total aggregate liability for all claims will not exceed the greater of the amount you paid Archivow in the 12 months before the claim or fifty U.S. dollars ($50). Some jurisdictions don’t allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Archivow and its owner, operators, and suppliers from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your content, your use or misuse of the Service, your violation of these Terms or any law or third-party right, or any immigration filing or decision you make based on materials organized through the Service.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you violate these Terms, if required by law, to protect the Service or others, or if we discontinue the Service. Export and deletion of your data are governed by our Privacy Policy and the in-app export/delete tools. Sections that by nature should survive termination will survive.
13. Disputes and governing law
These Terms are governed by the laws of the State of [State] and applicable U.S. federal law. Before bringing any formal claim, you agree to contact us at hello@archivow.com and try to resolve it informally for at least 30 days. [Arbitration / class-action-waiver clause to be finalized by counsel.] To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in [county, State].
14. General
We may update these Terms; material changes will be posted with a new date or notified to you, and continued use after they take effect means you accept them. If any provision is held unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them in a merger or sale. These Terms, with the Privacy and Refund Policies, are the entire agreement between you and Archivow regarding the Service. Questions? hello@archivow.com.
